This website is operated by KiraKira Life and Beauty Ltd., doing business as KiraKira Gift. Throughout the site, the terms “we,” “us,” and “our” refer to KiraKira Gift.

By visiting kirakiragift.com, using our website, or purchasing products from us, you agree to be bound by these Terms of Service. Please read these Terms carefully before using our website.

1. Online Store Terms

By placing an order, you confirm that you are legally capable of entering into a binding agreement in your province, state, or country.

You may not use our website or products for any illegal, fraudulent, unauthorized, or abusive purpose.

We reserve the right to refuse, limit, or cancel any order where we reasonably suspect fraud, unauthorized resale activity, payment issues, pricing errors, inventory errors, or misuse of our website.

2. Products and Product Information

We sell gifts, toys, plush products, collectibles, accessories, stationery, household products, character merchandise, and other retail products.

We make reasonable efforts to display product descriptions, colours, sizes, measurements, packaging, and photographs accurately. However:

• Colours may appear differently depending on the customer’s screen;
• Packaging may differ from the photographs shown;
• Measurements may vary slightly;
• Products from different production batches may have minor differences;
• Minor loose threads, small marks, uneven stitching, packaging dents, or other minor cosmetic variations that do not affect normal use are not necessarily considered defects.

Customers are responsible for reading the full product description, measurements, materials, age recommendations, and other product information before purchasing.

Product availability is not guaranteed. We may limit quantities, discontinue products, correct product information, or cancel an order if an item is unavailable.

3. Prices, Taxes, and Payment

Prices are shown in the currency displayed at checkout.

Applicable taxes, shipping charges, customs duties, brokerage fees, and other charges may be added at checkout or charged separately by the carrier or customs authority.

Customers must provide accurate billing and payment information. An order is not confirmed until payment has been successfully processed.

We reserve the right to correct genuine pricing, inventory, or listing errors. If an error affects an order that has already been placed, we may cancel the affected item and issue a refund.

4. Final Sale Policy

All purchases are final sale. We do not accept returns, exchanges, or cancellations unless the customer receives an incorrect, materially damaged, or defective product, or unless a refund or other remedy is required by applicable law.

We do not provide refunds, returns, or exchanges for:

• Change of mind;
• Ordering the wrong product, colour, size, style, or quantity;
• Personal preference;
• Duplicate purchases;
• Failure to read the product description or measurements;
• Minor differences in colour, packaging, size, stitching, printing, or appearance;
• Minor cosmetic imperfections that do not affect normal use;
• Clearance or discounted products;
• Mystery products or surprise products;
• Seasonal products;
• Refused or unclaimed packages;
• Customer-caused damage, misuse, improper handling, or normal wear and tear.

Nothing in this policy limits any consumer rights that cannot legally be excluded.

5. Damaged, Defective, or Incorrect Products

Customers must inspect their order promptly after delivery.

Any claim involving an incorrect, materially damaged, or defective product must be submitted to us within 7 days of the delivery date.

The customer must provide:

• The order number;
• A clear description of the issue;
• Clear photographs or video of the product;
• Photographs of the original packaging;
• A photograph of the shipping label; and
• Any other information reasonably required to review the claim.

Customers must not discard, alter, wash, use, repair, or return the product before receiving instructions from us.

After reviewing the claim, we may provide an appropriate remedy, including:

• A replacement;
• A refund for the affected product;
• Store credit, with the customer’s agreement; or
• Another remedy required by applicable law.

Shipping damage must be reported with photographs of both the damaged product and the external shipping packaging.

6. Order Changes and Cancellations

Once an order has been submitted, changes or cancellations are not guaranteed.

Orders may be processed and packed quickly. Customers must contact us immediately after noticing an error. Once an order has been processed, packed, or shipped, it cannot be changed or cancelled.

We may cancel an order if:

• A product is unavailable;
• A product was incorrectly priced;
• There is an inventory or listing error;
• Payment cannot be verified;
• Fraud or unauthorized activity is suspected; or
• The product cannot legally or reasonably be shipped.

If we cancel an order or item, the amount paid for the cancelled portion will be refunded.

7. Shipping and Delivery

Shipping and delivery dates are estimates only unless expressly guaranteed in writing.

Delivery may be affected by carrier delays, weather, customs processing, labour disruptions, peak shopping periods, transportation interruptions, incorrect addresses, or other circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

We are not responsible for delays, failed delivery, additional shipping charges, or lost packages caused by an incorrect or incomplete address supplied by the customer.

8. Returned, Refused, or Unclaimed Packages

If a package is returned to us because of:

• An incorrect or incomplete address;
• Refusal of delivery;
• Failure to collect the package;
• Unpaid customs duties or brokerage fees;
• Unsuccessful delivery attempts; or
• The customer’s failure to cooperate with the carrier,

the customer may be responsible for all original and additional shipping costs.

Original shipping charges are non-refundable unless the return resulted from our error or a refund is required by law.

Any refund approved for a returned package may be reduced by shipping charges, return shipping costs, customs charges, and other expenses incurred by us.

9. Lost, Stolen, or Missing Packages

A delayed package is not automatically considered lost.

Customers must first:

• Review the tracking information;
• Contact the shipping carrier;
• Check with household members, neighbours, concierge staff, mailrooms, parcel lockers, and other possible delivery locations.

If tracking shows that a package was delivered but the customer cannot locate it, the customer must contact us promptly.

We may assist with a carrier investigation. However, we are not responsible for theft, loss, or damage occurring after confirmed delivery, except where required by law.

Refunds or replacements for packages lost in transit will be considered after the carrier confirms the loss or completes its investigation.

10. Canada and United States Orders

We currently ship to eligible addresses in Canada and the United States.

Customers in the United States may be responsible for import duties, customs charges, brokerage fees, state taxes, or other government charges.

Unless expressly stated at checkout, customs duties, brokerage fees, and import charges are not included in the product price or shipping charge.

Customers are responsible for ensuring that the products they order may legally be imported into and used in their destination.

We are not responsible for customs delays, customs inspections, rejected imports, or fees imposed by customs authorities or shipping carriers.

11. Promotions and Discount Codes

Promotions and discount codes:

• Cannot be redeemed for cash;
• Cannot be applied to previous purchases;
• Cannot be combined unless expressly permitted;
• May be limited to certain products or order values;
• May expire or be withdrawn where legally permitted.

Only one discount code may be used per order unless otherwise stated.

12. Intellectual Property

All original website content, including text, graphics, logos, photographs, product arrangements, website design, and promotional materials, belongs to KiraKira Life and Beauty Ltd. or is used with permission.

Third-party character names, trademarks, logos, images, and other intellectual property belong to their respective owners.

The sale of character merchandise does not mean that KiraKira Gift is sponsored, operated, or officially endorsed by the relevant intellectual-property owner unless expressly stated.

You may not copy, reproduce, distribute, scrape, republish, commercially exploit, or use our original website content without written permission.

13. Prohibited Uses

You may not:

• Use the website for fraudulent or unlawful purposes;
• Submit false payment, billing, or shipping information;

Any dispute will be subject to the courts located in Ontario, except where mandatory consumer-protection law permits the customer to bring a claim in another jurisdiction.
